HEAVENLY FATHER, IN MOMENTS OF UNCERTAINTY AND CHANGE, WE PAUSE AND LEAN INTO YOUR PEACE. SOFTEN OUR HEARTS WHERE THEY HAVE GROWN WEARY, CALM OUR MINDS WERE ANXIETY TRIES TO TAKE ROOT. HELP US RESPOND TO ONE ANOTHER NOT WITH FEAR OR FRUSTRATION, BUT WITH EMPATHY, PATIENCE AND COMPASSION. THIS FIRST ITEM IS A REQUEST THAT THE CITY COUNCIL CONSIDER ADOPTION OF A RESOLUTION IN SUPPORT OF THE TYLER SENIOR VILLAGE HOUSING TAX CREDIT PROPOSAL, LOCATED AT 712 NORTH BROADWAY AVENUE, AND ALSO THE APPROVAL OF A WAIVER OF DEVELOPMENT AND PERMIT FEES IN THE AMOUNT OF $500. SO THIS THIS PROJECT IS ASSOCIATED WITH A TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS 9% TAX CREDIT PROJECT. AND SO EACH YEAR, THE THERE'S REQUESTS FOR PROPOSALS TO TO TAKE PART OF THAT THAT STATE OR THAT THAT THAT PROGRAM AND PROJECTS RECEIVE POINTS FOR FOR LOCAL RESOLUTIONS AND SUPPORTS. AND SO THE REQUEST HERE IS THAT THE CITY COUNCIL MAKE A RESOLUTION OF SUPPORT FOR THIS PROJECT. IT IS THE ONLY PROJECT THAT THE CITY RECEIVED THIS YEAR. THE PREVIOUS YEARS. WE WE DO HAVE OTHER ONES TO CONSIDER THIS.

THIS PROJECT HERE IS ON 712 NORTH BROADWAY. IT'S AT THE CORNER OF WEST BOW STREET AND NORTH BROADWAY. IT'S CURRENTLY A CHURCH. THE APPLICANT PLANS TO ADAPTIVELY REUSE THE PROPERTY FOR SENIOR HOUSING. AND SO THEY THEY PLAN TO REMODEL THE THE EXISTING STRUCTURE USING THE THE HOUSING TAX CREDITS FOR AFFORDABLE HOUSING BUT ALSO UTILIZE HISTORIC TAX CREDITS AS WELL. AND SO THAT WILL ALSO ENSURE THAT THE ANY MODIFICATIONS TO THE STRUCTURE WILL ALSO BE RETAINED. ITS HISTORICAL CHARACTER. THE APPLICANT PLANS TO DEVELOP 4848 TO 52 UNITS LIMITED TO TO SENIOR HOUSING. SO 55 PLUS AND THEN ALSO. ALSO TO NOTE THAT THIS PROPERTY IS WITHIN THE THE DOWNTOWN PLANNING AREA. AS YOU SEE HERE, THE PROPERTY IS CURRENTLY ZONED FOR COMMERCIAL AND AND SO IT WOULD REQUIRE A ZONE CHANGE IN THE FUTURE TO DOWNTOWN BUSINESS AND CULTURAL DISTRICT, WHICH IS WHICH IS APPROPRIATE FOR THIS LOCATION SINCE IT IS IN THE DOWNTOWN AREA. GOOD MORNING, MAYOR AND COUNCIL. MORNING. MORNING, HEATHER. NICK, ASSISTANT CITY MANAGER. AND WE HAVE A A BUDGET AMENDMENT FOR YOU TODAY FOR THE 2526 BUDGET YEAR. THIS IS FOR TWO PROJECTS.

THIS IS TO ALLOW FOR ADDITIONAL FUNDING FOR THE TRS THREE PROJECT FOR THE EAST MAPLE ESTATES PROJECT THAT WE HAVE BEEN WORKING WITH OUR PARTNER IN THE NORTH END FOR FOR THOSE STREETS FOR A MIXED USE DEVELOPMENT. AND THEN THE SECOND ITEM IS FOR A DEVELOPMENT SERVICES BUDGET AMENDMENT FOR 50,000, ALLOWING FOR A WATERSHED TIMING ASSESSMENT. AND THE REASON FOR THAT IS TO ALLOW FOR TARGETED WATERSHED BASED APPROACH THAT IMPROVES FLOOD MANAGEMENT OUTCOMES WHILE REDUCING UNNECESSARY REGULATORY BURDEN OR IDENTIFICATION OF AREAS THAT WOULD REQUIRE DETENTION. SO REALLY WHAT THIS DOES IS IT IT VERIFIES DETENTION FACILITIES THAT NEED TO BE LOCATED IN CERTAIN AREAS. SO IT'S REALLY A IT WILL ALLOW FOR US TO MAKE COMMON SENSE APPROACHES AND NOT UNDER OR OVER ENGINEER. [M-1 Request that the City Council consider authorizing the City Manager to execute an engineering agreement in the amount of $148,805 with IMEG Consultants Corp for the design and construction phase services for the Elm Street Building Foundation Remediation project.]

HEATHER M1 CAMERON. GOOD MORNING. MAYOR AND COUNCIL, CAMERON WILLIAMS, DIRECTOR OF ENGINEERING SERVICES. SO M1 IS A ENGINEERING AGREEMENT WITH IMG CONSULTING CORP FOR ELM STREET BUILDING FOUNDATION REMEDIATION PROJECT. SO TO GIVE YOU CONTEXT OF THIS LOCATION IS THERE'S A CULVERT THAT KIND OF RUNS UNDER BROADWAY AND ALONG ELM STREET. IT DOES GO UNDERNEATH SOME BUILDINGS. THE FOCUS THAT RIGHT FOR THIS SPECIFIC CONTRACT IS KIND OF THAT RED AREA, THE CIRCLE THAT YOU SEE ON THE SCREEN. SO JUST A LITTLE BIT BACKGROUND FOR THIS AREA BACK IN NOVEMBER THERE WE DID DISCOVER A COLLAPSE OF PARTIAL OF THIS CULVERT, WHICH UNDERMINED ONE OF THE COLUMNS FOR SOME OF THOSE BUILDINGS THAT AT THAT LOCATION. AND SO WE DID GO IN THERE AND DO SOME IMMEDIATE SHORING UP AND ALSO INSTALL THESE STEEL PLATES TO PROVIDE SOME ADDITIONAL PROTECTION AGAINST FURTHER EROSION IN THAT AREA. AND THIS SPECIFIC CONTRACT. SO THE NEXT ITEM, YOU'LL KIND OF SEE ANOTHER CONTRACT FOR SOME DRAINAGE ANALYSIS. BUT THIS IS REALLY SPECIFIC TO THE BUILDING TO IDENTIFY, YOU KNOW, WHAT IS THE EXISTING CONDITIONS. AND ALSO ASSESS WHAT DO WE NEED TO DO TO SHORE UP THAT COLUMN AND THAT SLAB. AND IT'S BUILT INTO TWO PHASES. AND THIS PHASE KIND OF DOES THAT INITIAL DESIGN PIECE AND ALSO COMES UP WITH A COST ESTIMATE AT A 30% LEVEL. AND SO AT THAT POINT WE CAN KIND OF PAUSE AND DECIDE HOW DO WE MOVE FORWARD. PHASE TWO WOULD BE GOING TO FULL DESIGN FOR THIS PROJECT AND POTENTIAL BID AND CONSTRUCTION PHASE SERVICES.

AND AGAIN SEPARATING OUT THESE TWO TWO DIFFERENT CONTRACTS. THIS IS SPECIFIC TO THE

BUILDING. HOW DO WE SHORE UP WHAT HAPPENED WITH THAT COLLAPSE OF THE CULVERT AND THE EROSION THAT OCCURRED? AND THEN HOW DO WE STEP THROUGH THIS AND FIND THE MOST COST EFFECTIVE SOLUTION FOR THE PROJECT? SO, CAMERON, HOW DO YOU IN THE PICTURE UNDERNEATH OF THIS IS BETHEL CHURCH BUILDING. FOUNDATION FOOTING IS UNDERMINED. HOW DO YOU DETERMINE WHAT IS THE CITY'S RESPONSIBILITY AND WHAT'S THE PRIVATE PROPERTY OWNER'S RESPONSIBILITY. SURE. SO SOMETHING THAT WE'RE DEFINITELY GOING TO STEP THROUGH FROM THAT PERSPECTIVE IS THIS DRAINAGE STRUCTURE DID FAIL. AND SO WITHOUT THAT FAILURE, WE DO NOT THINK WE WOULD HAVE SEEN THIS UNDERMINING OF THE COLUMN AND THE SLAB. AND SO THAT'S REALLY WHY WE'RE TAKING THE APPROACH OF DOING THIS STUDY TO IDENTIFY WHAT'S ASSOCIATED WITH THAT COLUMN AND THAT SLAB, AND ISOLATE THAT PIECE OF THE PUZZLE. IS BETHEL ACTUALLY USING THAT BUILDING RIGHT NOW? SO WE HAVE BEEN HAD SEVERAL CONVERSATIONS WITH THEM AND HAVE ASKED THEM NOT TO USE THAT BUILDING JUST FOR SAFETY PRECAUTIONS. YES, SIR. THIS KIND OF GIVES YOU THE BREAKDOWN OF THOSE DIFFERENT TASKS. THAT TASK 100 IS REALLY THAT FIRST PHASE WHERE WE IDENTIFY THAT BASE ASSESSMENT. WE GET THAT 30% DESIGN AND COST ESTIMATE, WHERE WE CAN PAUSE AND DECIDE HOW WE WANT TO MOVE FORWARD. AND THEN THOSE ADDITIONAL PHASES WOULD BE BROKEN UP IN THIS CONTRACT. IF WE WANT TO DO FULL DESIGN, WE GO TO THE NEXT STEP. IF WE WANT TO DO BID PHASE SERVICES, CONSTRUCTION PHASE SERVICES, SO WE CAN STOP THAT AT ANY POINT ALONG THE PROCESS AND HOW THIS IS SET UP. AND WE'VE ALSO GOT $20,000 CONTINGENCY IN THERE. JUST BECAUSE THIS IS A YOU'RE DEALING WITH SOME UNKNOWNS. AND SO WE WANTED TO HAVE THAT AVAILABLE IF WE NEEDED IT WITH THIS CONTRACT. AND SO IT IS REQUESTED THAT CITY COUNCIL AUTHORIZE THE CITY MANAGER TO EXECUTE AN ENGINEERING AGREEMENT IN THE AMOUNT OF $148,805 WITH IMAD CONSULTING CORP FOR THE DESIGN AND CONSTRUCTION PHASE SERVICES FOR THE ELM STREET BUILDING FOUNDATION REMEDIATION PROJECT.

SO HOW LONG DOES THAT DRAINAGE SYSTEM BEEN THERE? SOME OF IT, WE BELIEVE, DATES BACK TO THE 1800S, 1930S, WAS WHEN SOME OF THAT CONSTRUCTION WAS DONE, WE BELIEVE. SO IT'S KIND OF HARD TO TELL, BUT BASED YOU SEE THAT GOING, IF I WERE TO GO BACK IN IN TIME TO THAT LOCATION, MAP, THE CONSTRUCTION OF THAT CULVERT, HOW IT WAS CONSTRUCTED, CHANGES THROUGHOUT THE PORTIONS.

AND SO LIKE THAT GREEN IS A MUCH BETTER, NEWER CONSTRUCTION PIECE. AND THEN AS YOU GO THROUGH. SO IT REALLY VARIES AND THROUGH THROUGHOUT THE WHOLE PORTION OF THE CULVERT.

AND THAT WAS PROBABLY ALL NATURAL DRAINAGE BECAUSE ON THE EAST SIDE THAT'S WHERE THE SPRINGS WERE, THE SPRING STREET, THE ORIGINAL CITY. RIGHT. SO THAT'S PROBABLY ALL WAS ORIGINAL NATURAL. YEAH. AND SO AS YOU MOVE FROM BROADWAY OVER TO FANNIN, IT ACTUALLY DRAINS TO THE NORTHEAST IN THIS CASE. AND THEN ULTIMATELY WHEN IT GETS TO FANNIN IS WHERE IT DAYLIGHTS AND GOES UNDERNEATH THE RAILROAD AND BECOMES THAT OPEN CHANNEL EAST OF DOWNTOWN.

IMPORTANT TO NOTICE THERE IS A LOT OF WATER GOING THROUGH HERE AND KIND OF SPEAK TO THAT IN THE SECOND CONTRACT, WHY THEY'RE SEPARATE AND WHAT WE'RE LOOKING AT WITH THAT ONE. BUT THERE ARE ADDITIONAL BYPASSES OF RCP PIPE THAT TAKE ADDITIONAL WATER OUT OF THIS CULVERT BECAUSE OF SO MUCH THAT'S GOING THROUGH THAT AREA. CAMERON, HOW COMMON IS THAT DRAINAGE SYSTEMS UNDERNEATH BUILDINGS DOWNTOWN? ME SO, I MEAN, WE DON'T DO THAT TODAY, RIGHT? WE HAVE SEEN THAT IN THE PAST. SO TYPICALLY IT'S NOT SOMETHING THAT YOU WOULD DO.

BUT, YOU KNOW, AND LOOKING AT THIS ONE WE DO KNOW OF ONE, I THINK ALONG AVENUE AND LATE 2018, 2017 TIME PERIOD WHERE THERE WAS ANOTHER STRUCTURE THAT WAS UNDERNEATH A HOUSE.

SO AGAIN M1 WAS ASSOCIATED WITH THE BUILDING COMPONENT. THIS IS SPECIFIC TO THE CULVERT. WE KNOW THAT WE'VE HAD THAT COLLAPSE. WE'VE DONE THAT IMMEDIATE RESHORING TO TO KEEP THINGS IN A CONDITION THAT WE FELT WAS ACCEPTABLE. HOW DO WE MOVE FORWARD FROM HERE? WE KNOW THAT THE REST OF THE CULVERT HAS OTHER ISSUES AS WELL. AND SO AGAIN, THIS KIND OF SIMILAR AREA, YOU SEE THE EXTENTS OF THAT CULVERT IN THIS LOCATION MAP, THIS PHASE ONE, WHICH IS THE ENTIRE ENGINEERING CONTRACT FOR THIS PHASE, IS REALLY JUST ASSESSING THE DRAINAGE NEEDS. HOW MUCH WATER DO WE ACTUALLY HAVE COMING THROUGH HERE. IS THAT PIPE IS THAT CULVERT SIZED CORRECTLY

TODAY? IF WE'RE GOING TO HAVE TO DO SOMETHING, DO WE NEED TO UPSIZE IT OR IS IT ADEQUATE.

AND THAT CAN ALSO LEAD TOWARDS WHAT STEPS DO WE TAKE TO IMPROVE IT. AND SO DOCUMENT THOSE EXISTING CONDITIONS. DO THAT ANALYSIS ON THE THE WATER NEEDS AND THEN IDENTIFY ALTERNATIVES. DO WE REPAIR IT. DO WE KIND OF REPLACE THAT IN PLACE OR DO WE REROUTE. AND WHAT'S THE MOST COST EFFECTIVE MEASURE THAT WE CAN DO TO ADDRESS THIS ISSUE. AND SO THAT KIND OF GIVES YOU A HIGH LEVEL REVIEW. AGAIN SPEAKING TO WHAT ARE OUR OPTIONS AND HOW DO WE MOVE FORWARD IN THE BEST BEST METHOD. CAMERON, IS THAT CULVERT IN GOOD SHAPE AS YOU TRAVEL EAST? WHEN YOU HEAD TOWARDS THE RAILROAD TRACKS AND BECOMES OPEN AND GO BACK TO THE. YEAH. SO YEAH. SO STARTING FROM FROM BROADWAY AND MOVING EAST. SO THAT GREEN PORTION THAT YOU SEE ON THE MAP, WE FEEL LIKE IS IS CODY BANE. WHEN OUR PROJECT ENGINEERS HAS DONE AN ASSESSMENT, REVIEW OF THAT AND THAT SECTION WE FELT LIKE IS IN GOOD SHAPE. THE RED PORTION THERE IS AGAIN, YOU SEE CHANGES IN THE CONSTRUCTION, BUT AS YOU MOVE TOWARDS THE RAILROAD TRACK, THE REALLY THERE'S ALMOST NO BOTTOM IN RUBBLE ON THAT CULVERT. AND ALSO THE WALLS HAVE HOLES. AND BECAUSE SOME OF IT IS ROCK THAT WAS GROUTED IN THERE AND SO SOME OF THAT NEEDS TO BE REPAIRED. AND AGAIN, SO THE ENTIRE PORTION THERE MAY BE SAY, HEY, WE NEED TO DO THIS MAINTENANCE PIECE HERE TO IMPROVE THAT AND MAKE IT BETTER AND MAKE IT WATERTIGHT. SO THAT'S ANOTHER CONCERN IS WE'VE GOT MAYBE WATER JUST JUST LEAKING IN AND OUT OF THIS CULVERT BECAUSE OF THE CONDITION OF IT. SO WHAT'S THE TIMING OF STREET CLOSURES. AND DO ALL THE BUSINESSES IN THERE LIKE MAX GUN SHOP, DO THEY HAVE ACCESS TO THEIR BUILDINGS AND ALL THAT DURING THIS TIME? SO IT'S CURRENTLY CLOSED, ASSOCIATED WITH THE CONSENT DECREE PROJECT THAT'S GOING THROUGH DOWNTOWN? I MEAN, IT'S ACTIVE CONSTRUCTION. I WANT TO SAY WE'RE STILL 6 TO 8 WEEKS OUT, POTENTIALLY WITH THAT CLOSURE. AND SO THE INTENT WOULD BE HOPEFULLY ONCE THAT IS DONE, I MEAN, WE'RE STILL GOING TO BE DOING OUR ASSESSMENT. AS OF LAST WEEK, BROOKSHIRE'S IS IN THE COMPLETING THE FINAL TOUCHES ON THEIR NEW DRIVEWAY AND ANTICIPATES OPENING IT TO TRAFFIC LATER THIS WEEK OR EARLY NEXT WEEK, DEPENDING IMPROVING ACCESS AND FLOW IN THAT AREA.
